Terms and Conditions

1. SCOPE & CONTRACTING PARTIES 

1.1 These General Terms and Conditions, hereinafter referred to as GTC, apply to all contracts for the rental of apartments and rooms for accommodation concluded with HOMELY HUB, as well as for all other services and deliveries provided by the aforementioned company. 

1.2 The contracting parties are the customers and HOMELY HUB. 

1.3 The customer’s terms and conditions shall only apply if expressly agreed in text form.

2. RESERVATIONS/BOOKINGS 

2.1 By making a reservation/booking, the guest offers to conclude an accommodation contract. If the booked apartment is available, the guest will receive a reservation/booking confirmation from HOMELY HUB. This confirmation establishes an accommodation contract between HOMELY HUB and the guest. 

2.2 HOMELY HUB’s offers regarding available apartments are non-binding and subject to change. HOMELY HUB reserves the right to refuse to conclude an accommodation contract at its own discretion. 

2.3 If the guest books only a category of an offered property, the guest has no claim to accommodation in a specific apartment/unit. HOMELY HUB reserves the right to apply standard industry restrictions such as minimum stays, booking guarantees, or deposits for specific travel dates.

3. CANCELLATION TERMS/CANCELLATION BY CUSTOMER/NON-USE OF SERVICES (NO SHOW) 

3.1 A guaranteed reservation is only in place once the guest has made payment to HOMELY HUB. The guest may cancel this reservation free of charge, within the cancellation terms, by providing the relevant reservation number. If no cancellation right is agreed or if it has already expired, and HOMELY HUB does not agree to contract termination, HOMELY HUB retains the right to the agreed remuneration despite non-use of the service (no-show) or late cancellation. HOMELY HUB will credit any income from renting the room to other parties and deduct saved expenses. If the room is not rented out to others, HOMELY HUB may deduct a lump sum for saved expenses. In this case, the guest is obliged to pay 90% of the agreed price for overnight accommodation. The guest is free to prove that the claim did not arise or arose at a lower amount. In case of non-appearance for guaranteed multi-day reservations, all subsequent nights will be canceled from the first night, and the guest will have no claim to these nights. 

3.2 For reservations on the day of arrival, payment for the stay must be made immediately, typically within one hour, per §5.

4. OVERNIGHT PRICES & OTHER CHARGES 

4.1 The prices valid at the time of contract conclusion are those indicated by HOMELY HUB. The prices are inclusive of all legal taxes, fees, and charges, except for local charges owed by the guest, such as visitor’s taxes.

5. PAYMENT TERMS & INVOICING 

5.1 The price for the accommodation booked by the guest must always be paid in advance. 

5.2 Set-off by the guest is excluded unless the counterclaim is undisputed or legally established. 

5.3 Accepted payment methods include MasterCard, Visa, American Express, Klarna/Sofortüberweisung, PayPal, or regular bank transfer. Cash payments are not accepted. 

5.4 HOMELY HUB reserves the right to charge the payment methods on file for additional services used or breaches of the GTC. The guest expressly authorizes HOMELY HUB to do so. 

5.5 By making a reservation, the guest agrees to receive their invoice via download or email.

6. USE OF RESERVED APARTMENTS 

6.1 A reserved apartment is available to the guest for the period specified in the booking. 

6.2 The keys and/or parking permits provided by HOMELY HUB must be returned to HOMELY HUB, a designated third party, or a designated drop-off point at departure. In case of loss or non-return of these items, a fee of €50.00 is incurred. HOMELY HUB may claim further damages if the damage exceeds €50.00, including the cost of changing the locking system if necessary for security reasons. The guest is free to prove that no damage or less than the claimed damage was caused to HOMELY HUB. 

6.3 A late check-out may be arranged between HOMELY HUB and the guest upon request and subject to availability. If HOMELY HUB agrees to the late check-out, it is entitled to charge €10.00 per hour or part thereof for the additional use of the apartment. In the absence of agreement, €30.00 per hour or part thereof applies. For check-out delays exceeding 3 hours, the full overnight price is charged if agreed; otherwise, the guest owes the full overnight price plus compensation for further resulting damages. The guest is free to prove that no or a lesser amount of damage was caused. 

6.4 The guest has no contractual right to a late check-out. 

6.5 An early check-in may be arranged upon request and availability. If HOMELY HUB agrees to the early check-in, it may charge €10.00 per hour or part thereof. The guest has no contractual right to an early check-in.

7. SUBLETTING, RE-RENTING, USAGE 

7.1 Subletting or re-renting of the booked apartment is prohibited, especially if offered at a higher price than that listed by HOMELY HUB. HOMELY HUB reserves the right to cancel the reservation in these cases, particularly if the guest provides false information to third parties regarding booking type or payment. 

7.2 Using HOMELY HUB’s apartments for any purpose other than accommodation is prohibited, including commercial or illegal uses. Using the apartments for photo or video shoots is also prohibited without explicit consent. In case of such usage, HOMELY HUB reserves the right to cancel the reservation without a refund.

8. HOMELY HUB LIABILITY 

8.1 HOMELY HUB is liable without limitation for damages resulting from injury to life, body, or health, as well as for other damages based on willful or gross negligence by HOMELY HUB. In case of simple negligence, liability is limited to foreseeable, contractually typical damages, provided the breach concerns an obligation essential to the contract (cardinal obligation). 

8.2 In case of disruptions or deficiencies in HOMELY HUB’s services, HOMELY HUB will endeavor to resolve them upon immediate complaint by the guest or on becoming aware of them. 

8.3 HOMELY HUB is liable for items brought in by the guest as per legal provisions. Any claim expires if not reported promptly, except when a delay does not affect clarification. Special agreements must be made for valuables over €800.00 and other items exceeding €3,500.00 in value. 8.4 No contract of safekeeping is concluded if the guest is provided a parking space. HOMELY HUB has no duty of surveillance in these cases and is only liable for damage caused by willful or gross negligence. 

8.5 Claims against HOMELY HUB generally expire within one year from the start of the statutory limitation period, except for claims due to life, body, or health injuries or gross negligence by HOMELY HUB. 

8.6 HOMELY HUB assumes no liability for lost property. Lost items are returned upon request for a fee plus a processing fee of €15.00. HOMELY HUB stores lost items for six months before disposal.

9. DEPOSIT

9.1 HOMELY HUB may request a security deposit of €300.00 for stays of less than three months and an amount equal to one month’s accommodation fee for stays of three to six months. 

9.2 HOMELY HUB is obligated to settle the deposit within one month after the end of the accommodation contract.

10. CUSTOMER DATA 

10.1 HOMELY HUB collects and records guests’ email addresses and phone numbers to ensure communication. 10.2 HOMELY HUB is entitled to cancel a booking if the guest’s identity cannot be clearly verified due to missing or incorrect documentation.

11. TERMINATION OF THE ACCOMMODATION CONTRACT 

11.1 HOMELY HUB reserves the right to terminate the accommodation contract for an important reason, including force majeure or unauthorized use. 

11.2 The guest has no claim for damages in the case of legitimate termination by HOMELY HUB.

12. VOUCHERS 

12.1 Vouchers purchased from HOMELY HUB can only be used for HOMELY HUB services. Vouchers are non-refundable and non-transferable and cannot be exchanged for cash.

13. SMOKING BAN AND SAFETY DEVICES 

13.1 All HOMELY HUB apartments are non-smoking, including e-cigarettes, hookahs, and similar devices. 

13.2 Smoking is permitted on balconies/terraces. 

13.3 HOMELY HUB may charge €250.00 or more if smoking occurs in non-designated areas.

14. BAN ON PARTIES AND GATHERINGS 

14.1 Noise must be minimized, especially during quiet hours from 10 PM to 6 AM. 

14.2 HOMELY HUB strictly prohibits parties or gatherings. Violation may incur a cleaning fee of €500.00.

15. DAMAGE OR UNAUTHORIZED REMOVAL OF INVENTORY 

15.1 HOMELY HUB may charge for damages exceeding normal wear and tear, including legal costs.

16. PETS 

16.1 Pets are permitted by prior arrangement for a fee of €30 per pet, except for guide dogs.

17. MAINTENANCE 

17.1 Guests are required to treat apartments with care. HOMELY HUB may charge a minimum of €50.00 for excessive cleaning.

18. INTERNET USAGE 

18.1 HOMELY HUB provides internet access but prohibits illegal or abusive use. The guest must comply with third-party rights and indemnify HOMELY HUB against third-party claims arising from misuse.

19. DATA PROTECTION 

19.1 Privacy policies can be viewed at: homelyhub.de/datenschutz

20. FINAL PROVISIONS 

20.1 Amendments or cancellations to the accommodation contract or GTC require text form. 20.2 Place of fulfillment and payment is the location of the accommodation. 20.3 German law applies, excluding the UN Sales Convention.
